means, in relation to a party, any person who is an employee, officer, agent, or direct or indirect contractor (including subcontractor) of that party; Organisation may access the NHSD Test Environment for the following purposes themselves with the NHSD application programmable interface (APIs)"}]},{"type":"paragraph","attrs":{"localId":"c8d43c67-8628-41a1-96f6-e670539fa844"},"content":[{"type":"text","text":"(ii) to allow the Organisation to develop and test the integration between its applications and the NHSD to be used in the NHSD Test Organisation must:"}]},{"type":"paragraph","attrs":{"localId":"0a5fae61-bba7-40b4-a9b4-7ed05a855b56"},"content":[{"type":"text","text":"(i) not input or use, and must ensure that no person inputs or uses, any real or ‘live’ data in the NHSD Test Environment; and"}]},{"type":"paragraph","attrs":{"localId":"9ebdf192-0d44-4afb-a07e-97477e511399"},"content":[{"type":"text","text":"(ii) ensure that it has effective procedures in place to prevent any real or ‘live’ data being used with or input into the NHSD Test Environment."}]},{"type":"paragraph","attrs":{"localId":"a54ce4b1-fb4c-4769-bd0e-4b26d3603bb1"},"content":[{"type":"text","text":"“Real or live” data for the purposes of these Terms means data about any real person, and includes personal information or health information (as those terms are defined in "},{"type":"text","text":"Privacy Act 1988 ","marks":[{"type":"em"}]},{"type":"text","text":"(Cth) ("},{"type":"text","text":"Privacy Act","marks":[{"type":"strong"}]},{"type":"text","text":")), healthcare identifiers or identifying information (as defined in the "},{"type":"text","text":"Healthcare Identifiers Act 2010","marks":[{"type":"em"}]},{"type":"text","text":" (Cth) ("},{"type":"text","text":"Healthcare Identifiers Act","marks":[{"type":"strong"}]},{"type":"text","text":") or any other information whatsoever, belonging to an individual, healthcare recipient, healthcare provider or healthcare provider organisation, including other identifying information (as those terms are defined in the "},{"type":"text","text":"My Health Records Act 2012","marks":[{"type":"em"}]},{"type":"text","text":" ("},{"type":"text","text":"My Health Records Act","marks":[{"type":"strong"}]},{"type":"text","text":"))."}]},{"type":"paragraph","attrs":{"localId":"3c20f350-102f-47d2-b193-bb4cda69da2f"},"content":[{"type":"text","text":"The Organisation must not, and must ensure the Organisation’s Personnel do not, infringe or do, or omit to do anything, which, if done or omitted to be done would breach any law, including the Privacy Act, or that would put Healthdirect in breach of Privacy Act, the Healthcare Identifiers Act or the My Health Records Act."}]},{"type":"paragraph","attrs":{"localId":"e385adab-95c7-4fb7-b4c2-0475a03324a8"},"content":[{"type":"text","text":"The Organisation must promptly notify Healthdirect in writing and, in any event, within 24 hours of becoming aware that real or ‘live’ data, has been used with or input into the NHSD Test of access by the Organisation to the NHSD Test to Healthdirect’s approval of your NHSD Test Environment Access Request form and your ongoing compliance with these Terms, Healthdirect will grant the Organisation with access to the NHSD Test Environment."}]},{"type":"paragraph","attrs":{"localId":"ed3d2f03-e79b-4fed-87e5-4586b51e9d5a"},"content":[{"type":"text","text":"If access is unavailable for technical, operational or other reasons, Healthdirect will endeavour to notify the Organisation."}]},{"type":"paragraph","attrs":{"localId":"1b74a691-4563-4859-a63c-ca260a521d4c"},"content":[{"type":"text","text":"The Organisation acknowledges that the NHSD Test Environment may become unavailable and Healthdirect may not be immediately aware of this unavailability. and"}]},{"type":"paragraph","attrs":{"localId":"04016a03-b8b6-4a95-b3f9-b5edb98e74cb"},"content":[{"type":"text","text":"(ii) ensure any credentials / tokens provided are not distributed."}]}]}]},{"type":"tableRow","content":[{"type":"tableCell","attrs":{"colwidth":[52]},"content":[{"type":"paragraph","attrs":{"localId":"a94b6136-1f4b-4b5d-81d1-ec87b16c6b75"},"content":[{"type":"text","text":"7.","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[178]},"content":[{"type":"paragraph","attrs":{"localId":"b7fa25a2-511a-40a5-8fc5-92323d2f0ab9"},"content":[{"type":"text","text":"Security Incidents","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[379]},"content":[{"type":"paragraph","attrs":{"localId":"72e5e23b-a1f8-4e68-b958-b4cd38ecc913"},"content":[{"type":"text","text":"If the Organisation or any of the Organisation’s Personnel become aware of a Security Incident, the Organisation must, and must ensure its Personnel:"}]},{"type":"paragraph","attrs":{"localId":"ff94c2c2-0798-4878-87ba-6f9af4bd48d5"},"content":[{"type":"text","text":"(i) notify Healthdirect as soon as practicable, having regard to the severity of the incident;"}]},{"type":"paragraph","attrs":{"localId":"e38f49bc-1371-4bc1-ba86-521b1f06f33f"},"content":[{"type":"text","text":"(ii) provide reasonable details of the Security Incident to Healthdirect;"}]},{"type":"paragraph","attrs":{"localId":"3d4a02e6-b09b-497d-a8f3-44549fe1acce"},"content":[{"type":"text","text":"(iii) take all reasonable steps to respond to, mitigate against or prevent, or remediate, the impacts and consequences of any Security Incident;"}]},{"type":"paragraph","attrs":{"localId":"e3b7303f-6d62-4bc4-b23f-8d772a085b4c"},"content":[{"type":"text","text":"(iv) retain and preserve logs and other evidence regarding the Security Incident to help determine the cause, damage and likely source; and"}]},{"type":"paragraph","attrs":{"localId":"088f42d8-c84b-45d2-a01b-3416522cf1b9"},"content":[{"type":"text","text":"(v) take all appropriate steps to investigate and manage the Security Incident and keep Healthdirect informed."}]}]}]},{"type":"tableRow","content":[{"type":"tableCell","attrs":{"colwidth":[52]},"content":[{"type":"paragraph","attrs":{"localId":"18175c1d-eb0b-4b4a-94d0-1cf02391f096"},"content":[{"type":"text","text":"8.","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[178]},"content":[{"type":"paragraph","attrs":{"localId":"a5eef95c-a71e-4815-8363-4e48f07ba2e4"},"content":[{"type":"text","text":"Changes to these terms of access to the NHSD Test Environment","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[379]},"content":[{"type":"paragraph","attrs":{"localId":"5a109fa8-64ab-4bbc-aa4f-47f4e5589788"},"content":[{"type":"text","text":"Due to changing technical and operational requirements, Healthdirect may need to vary these Terms from time to time."}]},{"type":"paragraph","attrs":{"localId":"1f437397-a60b-491f-a930-a48c1216a185"},"content":[{"type":"text","text":"If Healthdirect needs to vary these Terms, it will:"}]},{"type":"paragraph","attrs":{"localId":"5cf99b98-420d-4834-aaf2-d67e0e593622"},"content":[{"type":"text","text":"(i) endeavour to give the Organisation at least 28 days’ prior written notice of the variations to these Terms; means, in relation to a party, any person who is an employee, officer, agent, or direct or indirect contractor (including subcontractor) of that party; Organisation may access the NHSD Test Environment for the following purposes themselves with the NHSD application programmable interface (APIs)"}]},{"type":"paragraph","attrs":{"localId":"c8d43c67-8628-41a1-96f6-e670539fa844"},"content":[{"type":"text","text":"(ii) to allow the Organisation to develop and test the integration between its applications and the NHSD to be used in the NHSD Test Organisation must:"}]},{"type":"paragraph","attrs":{"localId":"0a5fae61-bba7-40b4-a9b4-7ed05a855b56"},"content":[{"type":"text","text":"(i) not input or use, and must ensure that no person inputs or uses, any real or ‘live’ data in the NHSD Test Environment; and"}]},{"type":"paragraph","attrs":{"localId":"9ebdf192-0d44-4afb-a07e-97477e511399"},"content":[{"type":"text","text":"(ii) ensure that it has effective procedures in place to prevent any real or ‘live’ data being used with or input into the NHSD Test Environment."}]},{"type":"paragraph","attrs":{"localId":"a54ce4b1-fb4c-4769-bd0e-4b26d3603bb1"},"content":[{"type":"text","text":"“Real or live” data for the purposes of these Terms means data about any real person, and includes personal information or health information (as those terms are defined in "},{"type":"text","text":"Privacy Act 1988 ","marks":[{"type":"em"}]},{"type":"text","text":"(Cth) ("},{"type":"text","text":"Privacy Act","marks":[{"type":"strong"}]},{"type":"text","text":")), healthcare identifiers or identifying information (as defined in the "},{"type":"text","text":"Healthcare Identifiers Act 2010","marks":[{"type":"em"}]},{"type":"text","text":" (Cth) ("},{"type":"text","text":"Healthcare Identifiers Act","marks":[{"type":"strong"}]},{"type":"text","text":") or any other information whatsoever, belonging to an individual, healthcare recipient, healthcare provider or healthcare provider organisation, including other identifying information (as those terms are defined in the "},{"type":"text","text":"My Health Records Act 2012","marks":[{"type":"em"}]},{"type":"text","text":" ("},{"type":"text","text":"My Health Records Act","marks":[{"type":"strong"}]},{"type":"text","text":"))."}]},{"type":"paragraph","attrs":{"localId":"3c20f350-102f-47d2-b193-bb4cda69da2f"},"content":[{"type":"text","text":"The Organisation must not, and must ensure the Organisation’s Personnel do not, infringe or do, or omit to do anything, which, if done or omitted to be done would breach any law, including the Privacy Act, or that would put Healthdirect in breach of Privacy Act, the Healthcare Identifiers Act or the My Health Records Act."}]},{"type":"paragraph","attrs":{"localId":"e385adab-95c7-4fb7-b4c2-0475a03324a8"},"content":[{"type":"text","text":"The Organisation must promptly notify Healthdirect in writing and, in any event, within 24 hours of becoming aware that real or ‘live’ data, has been used with or input into the NHSD Test of access by the Organisation to the NHSD Test to Healthdirect’s approval of your NHSD Test Environment Access Request form and your ongoing compliance with these Terms, Healthdirect will grant the Organisation with access to the NHSD Test Environment."}]},{"type":"paragraph","attrs":{"localId":"ed3d2f03-e79b-4fed-87e5-4586b51e9d5a"},"content":[{"type":"text","text":"If access is unavailable for technical, operational or other reasons, Healthdirect will endeavour to notify the Organisation."}]},{"type":"paragraph","attrs":{"localId":"1b74a691-4563-4859-a63c-ca260a521d4c"},"content":[{"type":"text","text":"The Organisation acknowledges that the NHSD Test Environment may become unavailable and Healthdirect may not be immediately aware of this unavailability. Healthdirect excludes all liability for any unavailability of the NHSD Test Environment."}]},{"type":"paragraph","attrs":{"localId":"b6dc94e1-b0d0-47ca-976b-4cf7e1b01bc0"},"content":[{"type":"text","text":"The Organisation may only grant or facilitate access to the NHSD Test Environment by the Organisation’s Personnel from or via the Organisation’s IT systems."}]},{"type":"paragraph","attrs":{"localId":"f256c7f3-0095-4460-ac40-97cd3a797d50"},"content":[{"type":"text","text":"The Organisation must not allow any person who is not the Organisation’s Personnel to access the NHSD Test Environment without prior written approval from Healthdirect which may be given or withheld in the Healthdirect’s absolute discretion."}]}]}]},{"type":"tableRow","content":[{"type":"tableCell","attrs":{"colwidth":[52]},"content":[{"type":"paragraph","attrs":{"localId":"1113a940-66b0-4556-8aa8-bae8f5a94453"},"content":[{"type":"text","text":"4.","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[178]},"content":[{"type":"paragraph","attrs":{"localId":"1269cf81-4f89-4a32-b4aa-2180ac70f94e"},"content":[{"type":"text","text":"Guidance provided by the Healthdirect","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[379]},"content":[{"type":"paragraph","attrs":{"localId":"be494712-b752-46b1-84d1-7f70e45204fa"},"content":[{"type":"text","text":"Healthdirect will provide the necessary implementation guides to allow the Organisation to use the NHSD Test Environment. and"}]},{"type":"paragraph","attrs":{"localId":"04016a03-b8b6-4a95-b3f9-b5edb98e74cb"},"content":[{"type":"text","text":"(ii) ensure any credentials / tokens provided are not distributed."}]}]}]},{"type":"tableRow","content":[{"type":"tableCell","attrs":{"colwidth":[52]},"content":[{"type":"paragraph","attrs":{"localId":"a94b6136-1f4b-4b5d-81d1-ec87b16c6b75"},"content":[{"type":"text","text":"7.","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[178]},"content":[{"type":"paragraph","attrs":{"localId":"b7fa25a2-511a-40a5-8fc5-92323d2f0ab9"},"content":[{"type":"text","text":"Security Incidents","marks":[{"type":"strong"}]}]}]},{"type":"tableCell","attrs":{"colwidth":[379]},"content":[{"type":"paragraph","attrs":{"localId":"72e5e23b-a1f8-4e68-b958-b4cd38ecc913"},"content":[{"type":"text","text":"If the Organisation or any of the Organisation’s Personnel become aware of a Security Incident, the Organisation must, and must ensure its Personnel:"}]},{"type":"paragraph","attrs":{"localId":"ff94c2c2-0798-4878-87ba-6f9af4bd48d5"},"content":[{"type":"text","text":"(i) notify Healthdirect as soon as practicable, having regard to the severity of the incident;"}]},{"type":"paragraph","attrs":{"localId":"e38f49bc-1371-4bc1-ba86-521b1f06f33f"},"content":[{"type":"text","text":"(ii) provide reasonable details of the Security Incident to Healthdirect;"}]},{"type":"paragraph","attrs":{"localId":"3d4a02e6-b09b-497d-a8f3-44549fe1acce"},"content":[{"type":"text","text":"(iii) take all reasonable steps to respond to, mitigate against or prevent, or remediate, the impacts and consequences of any Security Incident;"}]},{"type":"paragraph","attrs":{"localId":"e3b7303f-6d62-4bc4-b23f-8d772a085b4c"},"content":[{"type":"text","text":"(iv) retain and preserve logs and other evidence regarding the Security Incident to help determine the cause, damage and likely source;
